Trust Litigation

The Trust Litigation attorneys at McLaughlin & Zerafa, LLP are experienced in representing Trustees of trusts as well as beneficiaries of trusts in litigation including:

  • Testamentary Trusts created in a Will
  • Living Trusts
  • Inter Vivos Trusts
  • Irrevocable Trusts
  • Revocable Trusts

We counsel Trustees on their many responsibilities, including their fiduciary duty, abiding by the Prudent Investor Act and balancing their responsibilities to both income and remaindermen beneficiaries.

We also counsel beneficiaries on their rights including the potential removal of a Trustee for breach of fiduciary duty, including the duty of care and duty of loyalty.

A beneficiary at any time can commence a proceeding to compel a Trustee to prepare and file an Accounting, which is detailed summary of all transactions the Trustee has taken over the life of the trust.

With both partners having accounting backgrounds, one of whom is also a certified public accountant the Trust Litigation attorneys of McLaughlin & Zerafa, are well-equipped to either prepare or review interim or final Trust Accountings.
